Arcom: Guarantor of Digital Accessibility in France

IPEOS is composed of experts in the field of digital accessibility, very vigilant about internet access and online solutions.

Since the entry into force of the order of 6 September 2023, an entity is at the heart of the monitoring and guarantee of digital accessibility in France: Arcom. This initiative is part of the law of 11 February 2005 for equal rights and opportunities, participation and citizenship of people with disabilities. The new article 47-1 gives the Arcom a crucial mission: to ensure compliance with the obligations relating to the accessibility of digital services.

The Responsibilities of the Arcom

Arcom plays a vital role in ensuring that digital services meet accessibility standards. In practice, it ensures that websites, mobile applications and intranets, among others, meet the required accessibility criteria. Some of its key responsibilities include:

Compliance Verification: Arcom must ensure that the services concerned clearly indicate their compliance with the accessibility rules on their home page.
Facilitating Access to Information: It must ensure that users can easily access an accessibility statement and the multi-year accessibility framework.
Reporting: Arcom also ensures that users have simple ways to report any breach of accessibility rules.
Compliance Control: It is responsible for controlling whether digital services comply with the RGAA, the general framework for improving accessibility.

Sanctions for Violations

In case of non-compliance, Arcom has measures to ensure compliance with legal obligations. After a formal notice, pecuniary sanctions of up to 25,000 euros may be imposed against corporate entities that are recalcitrant.

The Stakeholders

Arcom works with various actors, including legal entities governed by public law, private legal entities entrusted with a public service mission and companies exceeding a certain turnover threshold.

GRFA Obligations and Criteria

The RGAA, a key reference framework, allows for the assessment of the accessibility of a site and its contents according to international standards of digital accessibility. In France, the accessibility rate is calculated according to the strict criteria of the GAAR.

The ICT cheque is a financial aid to support Guadeloupean micro-enterprises and SMEs less than one year old in their digital transition. This assistance is in the form of a grant of up to €10,000, co-financed by the ERDF.

Online presence and security services are supported at 80%, while digital business transition services are supported at 40%. To apply for this support, you should:

50,000 € fine for non-compliance with the RGAA (General Accessibility Improvement Framework)

As of January 1, 2024, non-compliance with the accessibility of sites, already mandatory since the 2005 law, will be subject to financial penalties, the maximum amount of which will reach 50,000€. The Regulatory Authority for Audiovisual and Digital Communication (ARCOM) will be competent to identify and establish such violations, including by using automated collection methods, and to issue prior injunctions to sanctions.

This major step strengthens the regulatory framework to ensure digital inclusion for all citizens, regardless of their physical abilities. The grace period is clearly defined, and compliance with accessibility standards becomes a top priority.

Among the new provisions, if a sanctioned non-compliance persists more than 6 months after the imposition of the initial sanction, a new sanction may be imposed, thus marking an acceleration in the compliance process. This proactive approach aims to ensure that public administrations adapt quickly to ensure the accessibility of their online services.

Government Strengthens Digital Accessibility

The IPEOS TEAM certified digital accessibility experts welcomed the announcement of teams from **DesignGouv** who are fully committed to a crucial mission: Help public administrations make their online procedures accessible to people with disabilities.

As part of a mission for a departmental project, TEAM was able to use the tools necessary to promote the online launch of a platform that complies with #RGAA. In addition, this initiative is part of the ambitious goal set at the National Conference on Disability (CNH) held on 26 April, under the aegis of President Emmanuel Macron, to achieve 100% digital accessibility. The recent publication of an order by the Government reinforces this commitment and establishes sanctions to ensure compliance of websites of public administrations.

The New Measures in detail
The Ordinance introduces three key innovations to ensure accessibility of government websites:

Sanctions for non-compliance with accessibility : Since the 2005 law, website accessibility was already a legal requirement. However, failure to comply with this requirement is now punishable. Government websites that do not comply may be subject to fines of up to €50,000. This measure is intended to encourage governments to take concrete steps to make their online platforms accessible to all, without exception.

Arcom in the Accessibility Department : The Regulatory Authority for Audiovisual and Digital Communications (ARCOM) will play a central role in implementing these new provisions. It becomes competent to identify and verify the lack of accessibility of public administration websites. To do this, it will be able to rely on automated collection methods, thus ensuring a rigorous compliance monitoring. In addition, the ARCOM will have the power to issue prior injunctions for sanctions in case of non-compliance.

Repeat Sanctions for Repeat Offenders: To encourage rapid compliance of websites, the order introduces a deterrent measure. If a sanctioned violation persists more than 6 months after the imposition of the initial sanction, a new sanction may be imposed. Additional Obligations Maintained
In addition to these new features, some additional obligations remain unchanged. Failure to comply with these obligations is still punishable by penalties, with a ceiling set at €25,000. The government is thus sending a clear message that digital accessibility is not an option, but a necessity.
